Nicollette Sheridan‘s battery claim was dismissed from her lawsuit against “Desperate Housewives” creator Marc Cherry and ABC on Tuesday.
Judge Elizabeth Allen White ruled that the prosecution did not sufficiently meet the standard of proof for battery.
That means Cherry, whom Sheridan alleged had hit her on the head back in 2008, is no longer a defendant in the case.

Cherry had admitted to striking the actress, but claimed it was just a “tap.”
Closing arguments in the case, which will now center exclusively on Sheridan’s wrongful termination claims, were set to begin later today.
