Justin Mikita, husband of Jesse Tyler Ferguson, will not be prosecuted for his role in a fatal traffic accident in Los Angeles last November. The incident occurred when Mikita, driving an Audi, crossed a double-yellow line into oncoming traffic while attempting to make a left turn. Nick Trela, a 23-year-old riding a Honda motorcycle, crashed into Mikita’s vehicle. He died from his injuries.

The Los Angeles City Attorney has now determined that Trela was party to blame for the accident, because he was speeding. Moreover, eyewitnesses reportedly say Mikita’s left turn was a legal one, coming at a break in the double-yellow line. The City Attorney will NOT charge Mikita with vehicular manslaughter.

Trela happened to be engaged to Kirstie Alley’s 20-year-old daughter Lillie. His family is suing Mikita despite prosecutors’ decision not to prosecute him. “This is a horrible tragedy. I want to respect the family and the process, so I am not going to discuss any details of the accident or the complaint at this time,” Mikita says in a statement to TMZ. Gossip Cop will have updates.
